Court Rules UNM Foundation Records are Public

Attorney Nicholas Hart worked with his client, independent sports journalist Daniel Libit, to obtain records from the University of New Mexico Foundation regarding financial documents related to the University of New Mexico’s athletics department under the New Mexico Inspection of Public Records Act. The University of New Mexico and the University of New Mexico Foundation contended that because the records were held by the Foundation, they were not subject to disclosure. After extensive litigation and discovery, the court determined that the Foundation was subject to the Inspection of Public Records Act, and ordered that the documents be disclosed. Mr. Hart has represented Mr. Libit in other similar lawsuits against other entities associated with the University of New Mexico. The University, the Foundation, and another entity associated with the University of New Mexico appealed the court’s order. Mr. Hart continues to represent Mr. Libit in those appeals, which are currently pending before the New Mexico Court of Appeals.
