Nicholas Hart Argues in New Mexico Supreme Court

Our client, Paul Garcia, was charged with two counts of felony murder after allegedly stealing a van, fleeing a police traffic stop, and hitting another car, causing two individuals to be fatally injured. The two felony murder charges were then dismissed, after which the State appealed.

Attorney Hart represented Mr. Garcia on appeal, arguing to uphold the dismissal in the Supreme Court of the State of New Mexico. After the case returned to the trial, Mr. Hart and co-counsel continued to represent Mr. Garcia, obtaining for him a favorable plea agreement, resulting in less than one year of incarceration left to serve following the plea.
